These policies govern Next Mile Recruiting services, including Clarity System, Clarity Custom, and Clarity Advisory. They also explain how private family information and Clarity materials may be used.

Policy 01

Terms of Service

The working agreement between a family and Next Mile Recruiting.

1. Who we are and what these Terms cover

These Terms of Service (“Terms”) govern access to and use of the websites, communities, courses, dashboards, reports, PDFs, intake forms, and related services offered by Next Mile Recruiting LLC (“Next Mile Recruiting,” “NMR,” “we,” “us,” or “our”), including Clarity System, Clarity Custom, and Clarity Advisory (together, the “Services”).

By purchasing, enrolling in, accessing, or using a Service, you agree to these Terms. If you purchase for a family, you confirm that you are an adult with authority to make the purchase and provide information about the participating student-athlete.

2. What the Services are

The Services provide educational information, structured recruiting guidance, planning tools, school research, and family-specific analysis. Clarity Custom and Clarity Advisory may include an intake, a private dashboard, a family report, School Reports, and other supporting materials.

NMR is not a college, admissions office, athletic department, scholarship provider, sports agent, placement service, legal adviser, financial adviser, medical provider, or guarantor of recruiting results. Families remain responsible for their own decisions, communications, applications, eligibility questions, and verification of school or team information.

3. Accounts and access

You are responsible for providing accurate information, protecting your sign-in credentials, and promptly telling us if you believe an account or private link has been used without permission.

Access is personal to the authorized family members described in the Clarity Household Access and Sharing Policy. An unused family access spot cannot be transferred to a coach, consultant, teammate, another family, or another person.

4. Purchases and payments

Prices, payment timing, installment options, taxes, and any product-specific conditions are shown at checkout. Payments may be processed by Circle, Stripe, Afterpay, or another payment provider. Their separate terms may also apply to the payment transaction.

NMR generally receives payment status and transaction details needed to fulfill and document a purchase, but does not receive or store a customer’s full payment-card number.

5. Clarity Custom delivery

For Clarity Custom, the four-business-day delivery period begins when the family submits a completed intake, not when the family enrolls or pays. The submission day is not the first business day.

The Clarity Dashboard will be delivered no later than the end of the applicable fourth business day, Mountain Time. Federal holidays do not count as business days. If Jay finishes sooner, the family receives it sooner.

If an intake is incomplete or NMR must ask for information needed to begin the work, the delivery period begins after the required information is supplied.

6. Refunds and cancellations

Except where required by law or where checkout states a different product-specific rule, purchases are final once digital access is delivered or NMR begins personalized work. A cancellation does not erase amounts already owed for access or work already provided.

If a charge was duplicated or unauthorized, or NMR cannot provide the purchased Service, contact NMR promptly at info@nextmilerecruiting.com. NMR will review the account and correct or refund the appropriate amount. Payment-provider processing times and separate payment terms may also apply.

7. Family license and incorporated use policies

A purchase gives the authorized family a limited, personal license to use the applicable Services and materials. It does not transfer ownership of NMR’s courses, methods, analysis, templates, dashboards, reports, PDFs, School Reports, videos, interviews, written materials, or design.

The Clarity Household Access and Sharing Policy and the Clarity Intellectual Property and Personal Use Policy are part of these Terms. If a product page or checkout includes a narrower restriction, the narrower restriction controls for that product.

8. Information families submit

Families keep their rights in the personal facts and original information they submit. You give NMR permission to receive, store, organize, analyze, and use that information as reasonably needed to provide, secure, support, and document the Services.

You agree not to submit information you do not have permission to provide. NMR may rely on the information supplied by the family and is not responsible for errors caused by incomplete, outdated, or inaccurate answers.

9. Acceptable use

You may not misuse the Services, interfere with their security, attempt to enter another family’s private workspace, scrape or systematically extract content, bypass access controls, upload malicious code, impersonate another person, or use the Services unlawfully.

You may not copy, distribute, resell, publish, teach from, or commercially exploit protected NMR materials.

10. Service availability and changes

We work to keep the Services available and accurate, but online services may occasionally be interrupted for maintenance, security, provider outages, or other reasons. School, admissions, roster, cost, conference, and recruiting information can change, and families should verify time-sensitive facts with the school or governing organization.

NMR may improve or replace features while preserving purchased access and required legal rights. Material changes to these Terms will be dated and communicated in a reasonable way.

11. Suspension and termination

NMR may limit or suspend access when reasonably necessary to protect a family, the Services, NMR’s intellectual property, or other users; investigate suspected misuse; comply with law; or address nonpayment.

When practical, NMR will explain the issue and offer a reasonable opportunity to correct it. Serious or repeated violations may result in termination. Termination does not erase payment obligations or provisions that by their nature should continue, including ownership, confidentiality, license limits, and dispute provisions.

12. Disclaimers and limitation of liability

The Services are provided for educational and informational use. To the extent permitted by law, NMR does not promise admission, roster placement, coach interest, scholarship, financial aid, athletic eligibility, or any particular recruiting outcome.

To the fullest extent permitted by law, the Services are provided “as is” and “as available,” and NMR disclaims implied warranties of merchantability, fitness for a particular purpose, and noninfringement. NMR is not responsible for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Services.

To the fullest extent permitted by law, NMR’s total liability arising from the affected Service will not exceed the amount the family paid NMR for that Service during the twelve months before the event giving rise to the claim. These limits do not apply to fraud, gross negligence, willful misconduct, or rights and liabilities that cannot legally be limited.

13. Governing law and disputes

Colorado law governs these Terms, without regard to conflict-of-law rules. Before filing a lawsuit, the family and NMR agree to send written notice describing the dispute and make a good-faith effort to resolve it informally for at least thirty days.

Except for a matter eligible for small-claims court or a request for emergency or injunctive relief, any lawsuit relating to these Terms or the Services must be brought in the state or federal courts located in Jefferson County, Colorado, and each party consents to those courts’ jurisdiction.

14. Changes to these Terms

The effective date and version appear at the top of the published Terms. Material changes will apply prospectively after reasonable notice. If a material change requires renewed agreement, NMR will request it before continued use of the affected Service.

Policy 02

Privacy Policy

What NMR receives, why it is used, and how a family can ask questions.

1. Scope

This Privacy Policy explains how Next Mile Recruiting LLC collects, uses, discloses, and protects personal information in connection with its public website, Circle community, Clarity System, Clarity Custom, Clarity Advisory, private family dashboards, intake forms, reports, email communications, and support.

A separate Children’s Privacy Notice addresses use involving children under 13. Product-specific notices may provide additional detail and become part of this Policy.

2. Information we collect

  • Account and contact information, such as names, email addresses, account credentials, and communication preferences.
  • Purchase and enrollment information, such as product, price, payment status, transaction identifiers, discount information, and dates. Payment providers handle full card details.
  • Family and student-athlete intake answers, which may include graduation year, school year, gender, sport, event or position, academic information, athletic marks, geographic preferences, college interests, recruiting priorities, family context, questions, and narrative answers.
  • Service activity, such as sign-in events, submissions, dashboard access, report views, support requests, emails, and security or audit records.
  • Device and website information, such as IP address, browser, approximate location, referral page, cookies, and analytics events on public pages.
  • Information a family chooses to send in emails, forms, calls, meetings, or other support conversations.

3. Where information comes from

We receive information directly from purchasers, parents or legal guardians, and student-athletes; from platforms used to enroll or pay, such as Circle and payment processors; automatically from websites and applications; and from communications with NMR.

We may also use public school, college, team, conference, admissions, cost, roster, and athletic information to prepare educational materials and family-specific analysis.

4. How we use information

  • Provide, personalize, and deliver the Services, including creating family dashboards, reports, and School Reports.
  • Authenticate users, authorize private access, log private reads, prevent misuse, and investigate security events.
  • Process and document purchases, enrollment, discounts, refunds, and fulfillment.
  • Communicate about an intake, delivery, support, product access, policy changes, and service updates.
  • Maintain records, comply with law, enforce agreements, and protect families, NMR, and others.
  • Understand and improve public website performance and the general usability of the Services.

5. Our promise about private family answers

NMR does not sell the private answers a family submits through a Clarity intake. NMR does not use private family intake answers for targeted advertising.

Private answers are used to provide and protect the family’s Service, support the family, maintain necessary records, and meet legal obligations. Access inside NMR is limited to people and providers who need the information for those purposes.

6. When information is disclosed

NMR may disclose information to service providers that perform work for NMR, such as hosting, authentication, database, cloud infrastructure, email delivery, community, payment, customer support, analytics, security, and professional advisory services. They receive only the information reasonably needed for their role and are expected to protect it.

Information may also be disclosed when requested by the family; as part of a business transaction subject to appropriate protections; to comply with law or legal process; or when reasonably necessary to protect rights, safety, security, and the integrity of the Services.

NMR does not send a family’s private Clarity report or intake answers to coaches, schools, or other families as part of ordinary fulfillment.

7. Payment and community platforms

Circle and payment providers may collect account, community, and payment information under their own privacy policies. NMR receives the information needed to confirm enrollment, payment, access, and fulfillment.

The providers NMR uses may change as its systems evolve. NMR expects providers to use personal information only to perform their contracted services, protect their systems, and meet applicable legal obligations.

8. Retention

NMR keeps personal information only as long as reasonably necessary for the purposes described in this Policy, including fulfillment, support, account continuity, transaction records, security and audit records, dispute prevention, and legal obligations.

Different records may have different retention periods. Deleting an account may not immediately delete payment, security, audit, backup, or legal records that NMR must reasonably retain.

9. Security

NMR uses administrative, technical, and organizational safeguards designed to protect personal information. Private Clarity access is intended to require authentication and authorization, and private reads may be logged for security and accountability.

No system can guarantee perfect security. Families should use strong, unique passwords, protect private links and devices, and promptly report suspected unauthorized access.

10. Choices and privacy requests

Families may ask to access, correct, or delete personal information, or ask how it is being used, by emailing info@nextmilerecruiting.com. NMR will verify the request and respond as required by applicable law.

Depending on where a person lives, additional privacy rights may apply, including rights to know, correct, delete, or receive a copy of certain information, or to appeal a decision. NMR will not discriminate against a person for exercising a legal privacy right.

11. Student-athletes and children

NMR’s recruiting Services are designed for families of student-athletes, many of whom are teenagers. An adult parent, legal guardian, or authorized purchaser should create the account, make the purchase, and provide any consent required for a minor’s participation.

The Services are not directed to children under 13. NMR does not accept direct athlete email signups from visitors who are 13 or younger; they are directed to have a parent or guardian contact NMR instead. If NMR learns that personal information from a child under 13 was collected without appropriate authorization, NMR will take reasonable steps to delete it. See the Children’s Privacy Notice for more information.

12. Cookies, analytics, and public-site advertising

The NMR homepage may use optional Google Analytics and Meta advertising technologies to understand visits and measure advertising only after a visitor accepts optional cookies through the homepage cookie notice.

The Clarity sales pages, including /get-clarity and /clarity-system, do not use optional analytics or advertising cookies and therefore do not display a cookie notice. Essential technologies needed for security, forms, payments, sign-in, or a service requested by the visitor may still operate.

When a browser sends a recognized Global Privacy Control signal, NMR keeps optional analytics and advertising technologies off.

NMR does not send private Clarity intake answers, family reports, School Reports, or private dashboard activity to advertising platforms or use that information for targeted advertising.

13. Changes to this Policy

The effective date and version appear at the top of the published Policy. Material changes will be explained through a reasonable notice and, when required, renewed consent.

Policy 03

Clarity Household Access and Sharing Policy

Who may use the private work—and how the family keeps it private.

1. The simple rule

Clarity Custom Reports, Clarity Advisory materials, School Reports, private dashboards, and other PDFs are for one family group: no more than two parents or legal guardians and one student-athlete.

Those three people may live in different homes. The rule is about who the work is for, not whether everyone shares an address.

2. Who may have access

  • The student-athlete whose recruiting decisions the materials address.
  • Up to two of that student-athlete’s parents or legal guardians.
  • No substitute user for an unused spot. A coach, consultant, relative, teammate, family friend, or another family cannot take the place of a parent or guardian.

3. What stays inside the family group

The family group may read, discuss, and use its own Clarity Custom Reports, Clarity Advisory materials, School Reports, other PDFs, private dashboard, and personalized recommendations.

Those materials may not be forwarded, uploaded, posted, copied for, screen-shared with, or otherwise provided to a coach, recruiting service, consultant, school, team, teammate, another family, or anyone outside the authorized three people.

4. Talking with a coach is still allowed

This Policy does not prevent a family or student-athlete from having ordinary recruiting conversations, asking a coach a question, or acting on what the family learned.

The line is simple: the family may use the guidance, but may not give the coach access to the private dashboard or send the coach NMR’s report, School Report, PDF, screenshots, or substantial copied material.

5. Access methods and account security

Use only the invitation, account, or sharing method NMR provides. Do not post private links, share credentials outside the authorized group, or leave private materials available on a shared device or public drive.

If a family believes private access has been exposed, it should contact NMR promptly so access can be protected.

6. Changes in a family

Families change. If a parent or guardian should be replaced because of custody, guardianship, death, safety, or another legitimate family circumstance, contact NMR. NMR will handle the request reasonably and may ask for enough information to protect the student-athlete and existing account.

7. Why this limit exists

Clarity is priced and built as private work for one student-athlete and their parents or legal guardians. The limit protects the family’s information and the original research, organization, and analysis that make the work useful.

8. If the Policy is violated

Sharing Clarity materials outside the authorized three people is a material breach of the Terms. NMR may immediately suspend or terminate access, require every unauthorized copy to be deleted or returned, preserve evidence of the violation, and pursue all remedies available under applicable law.

Termination may be without a refund to the extent permitted by law. NMR may seek court orders stopping further use, damages, and recovery of legal costs where those remedies are available. The ability to download, print, screenshot, or forward a file does not create permission to do so.

9. No outside-use exceptions

There are no outside-use exceptions under a family purchase. NMR does not grant permission to share Clarity Custom Reports, Clarity Advisory materials, School Reports, private dashboards, PDFs, screenshots, or substantial copied material outside the authorized three people.

A family purchase cannot be expanded, transferred, sublicensed, or converted into access for a coach, consultant, school, team, organization, another family, or any other person. Do not obtain materials for someone else or use another family’s access.

Policy 04

Clarity Intellectual Property and Personal Use Policy

What the family owns, what NMR owns, and what the purchase allows.

1. The shared understanding

A family buys access to use Clarity for its own recruiting decisions. It does not buy the right to republish, teach, resell, distribute, or build a business from NMR’s materials.

2. What the family keeps

The family keeps its rights in the personal facts, original answers, documents, and information it supplies. NMR does not claim ownership of the student-athlete’s identity, marks, grades, goals, preferences, story, or other underlying family information.

The family may request access to or correction of its personal information as described in the Privacy Policy.

3. What NMR keeps

NMR and its licensors keep all rights in the original expression and protectable elements of the Services, including course content, videos, interviews, written guidance, methods as expressed, selection and arrangement, dashboards, visual design, templates, report structure, analysis, recommendations, School Reports, PDFs, graphics, software, branding, and updates.

Public facts, general ideas, and material that is not legally protectable remain outside NMR’s ownership. This Policy does not expand copyright or other rights beyond what the law allows.

4. The license a family receives

While the account is in good standing, NMR gives the authorized family a limited, nonexclusive, nontransferable, revocable license to access and use the purchased materials for the personal recruiting decisions of one student-athlete.

The authorized family may view the materials on its own devices and print a reasonable number of copies for the same two parents or legal guardians and one student-athlete.

5. Uses that are not included

  • Forwarding, posting, uploading, publishing, or distributing reports, School Reports, PDFs, videos, screenshots, downloads, or substantial copied text to anyone outside the authorized family group.
  • Selling, sublicensing, renting, gifting, or transferring access or materials.
  • Using NMR materials to provide paid or unpaid recruiting, coaching, consulting, advising, training, membership, course, newsletter, database, or report services to other people.
  • Teaching from, presenting, adapting, or repackaging NMR materials for a team, club, school, business, or audience.
  • Systematically scraping, downloading, recording, extracting, or using automated tools to reproduce or build a substitute for the Services.
  • Removing copyright, trademark, confidentiality, access, or attribution notices.

6. Coaches, consultants, and other families

A family may use what it learns in its own conversations and decisions, but may not give a coach, consultant, recruiting service, team, teammate, school, or another family access to the materials or copies of them.

A person who offers recruiting, coaching, consulting, or similar services may buy Clarity for their own child on the same family terms, but may not use that purchase to serve clients or other athletes.

7. Family-specific reports

A family-specific report combines the family’s underlying information with NMR’s research, selection, organization, analysis, recommendations, template, writing, and design. The family keeps its rights in its own underlying information; NMR keeps its rights in NMR’s protected contribution.

The family receives the personal-use license described above, not ownership of the reusable report system or the right to distribute the finished report.

8. No outside-use or commercial license

Clarity does not offer outside-use or commercial licenses. NMR will not authorize a team, coach, school, organization, consultant, recruiting service, or other business to copy, share, teach from, distribute, or use Clarity System, Clarity Custom, or Clarity Advisory materials.

A family purchase cannot be expanded, transferred, sublicensed, or converted into permission to use the materials for another athlete, a client, a team, a school, or any professional or organizational purpose. Do not obtain materials for someone else or use another family’s access.

9. Suspected misuse and enforcement

Any outside sharing, copying, resale, teaching, redistribution, or professional use is a material breach of the Terms. NMR may immediately suspend or terminate access, require every unauthorized copy to be deleted or returned, preserve relevant evidence, and pursue all remedies available under applicable law.

Termination may be without a refund to the extent permitted by law. NMR may seek court orders stopping further use, damages, and recovery of legal costs where those remedies are available. NMR does not need to wait for repeated misuse before acting.

10. Legal exceptions

Nothing in this Policy is intended to prohibit rights that cannot lawfully be restricted, including applicable fair-use rights, lawful government requests, legal process, or disclosures protected by law.
